Welcome to GKP By Design. These Terms and Conditions govern your use of our services, including all estimates, design work, and commissioned artwork. By engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not proceed with our services.

2. Definitions
“Company”
refers to GKP By Design.“Client” refers to the individual or business commissioning services from GKP By Design.

“Services” refers to the design, artwork, and related services provided by GKP By Design.

“Deliverables” refers to the final products or services provided to the Client.

“Agreement” refers to the legally binding contract formed by these Terms and Conditions.

3. Services
GKP By Design offers bespoke design services, including digital and hand-curated artwork. All services are provided based on estimates and agreed terms.

Estimates: Any estimate provided is based on the information available at the time and may be subject to change if the project scope is altered.

Revisions: Clients are entitled to a set number of revisions as agreed upon in the project scope. Additional revisions may be chargeable.

Delivery: We strive to meet all agreed deadlines; however, delays due to unforeseen circumstances may occur.

4. Fees and Payment Terms
Pricing
: All prices are provided in GBP (£) and are subject to VAT if applicable.

Invoices: Payment terms will be stated on each invoice, typically requiring payment within 7-14 days.

Late Payment Fees:If payment is not made by the due date, a 40% late fee will be added to the total invoice.If payment remains unpaid 7 days after the due date, legal action will be taken for the full payment, including the 40% fee.

The Client will be liable for all legal costs incurred in recovering outstanding payments.

Deposits: GKP By Design may require an upfront deposit before commencing work. This deposit is non-refundable unless explicitly agreed.

5. Client Responsibilities
Information Provision
: Clients must provide all necessary details, files, and feedback required for project completion.

Approval Process: Clients must review and approve work within specified timeframes to avoid delays.

6. Intellectual Property Rights
Ownership
: Until full payment is received, all rights to any deliverables remain with GKP By Design.

Usage Rights: Clients may not reproduce, modify, or distribute our work without prior written consent unless explicitly agreed.

7. Confidentiality
Both parties agree to keep any confidential information private and not disclose it to third parties without prior consent.

8. Limitation of Liability
GKP By Design is not liable for any indirect, incidental, or consequential damages resulting from the use of our services.Liability is strictly limited to the amount paid for the specific service in question.

9. Termination
Either party may terminate the agreement if the other party commits a material breach that is not rectified within 14 days.Upon termination, all completed work must be paid for, and all intellectual property rights remain with GKP By Design until full payment is made.

10. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.

11. Miscellaneous
Entire Agreement
: These Terms and Conditions constitute the entire agreement between GKP By Design and the Client.

Amendments: GKP By Design reserves the right to update these Terms and Conditions at any time. Changes will be communicated via our website.

Severability: If any provision in these Terms is found to be invalid or unenforceable, the remainder shall remain in full force and effect.

13. Force Majeure (Protection Against Unforeseen Events)
GKP By Design shall not be liable for any failure or delay in the performance of its obligations due to circumstances beyond its reasonable control. These include but are not limited to:

Natural disasters (e.g., floods, earthquakes, fires)
Pandemics or epidemics
Cyberattacks or IT system failures
Government-imposed restrictions
Supplier failures or other external disruptionsIf such an event occurs,

GKP By Design will notify the Client as soon as possible and take reasonable steps to resume services.

14. Refund and Cancellation Policy
Deposits
are non-refundable unless otherwise agreed in writing.If a Client cancels a project after work has commenced, they remain liable for payment covering work completed up to that point.Refunds are only considered in cases where GKP By Design fails to deliver agreed-upon services due to its own negligence.

15. Revisions & Additional Charges (Scope Creep Protection)
Each project includes 1 revision as agreed in the initial proposal.

Additional revisions beyond the agreed scope will be charged and be at a project by project basis.

Any substantial changes to the original brief may require a renegotiation of pricing and timelines.

16. Client Delays & Non-Response (Avoiding Project Stalling)
If the Client fails to provide necessary information, feedback, or approvals within 5 days of request, GKP By Design reserves the right to pause the project.If inactivity continues for more than 10days, the project may be considered abandoned, and no refunds will be issued.

17. Portfolio Rights (Right to Showcase Work)
GKP By Design reserves the right to display completed work in its portfolio, website, and marketing materials unless the Client requests otherwise in writing before project completion.

18. Data Protection & Privacy (GDPR Compliance)
GKP By Design is committed to protecting client privacy.Any personal data collected will be processed in accordance with the UK General Data Protection Regulation (GDPR).

We do not sell or share your data with third parties without your consent, except where required by law.

Clients may request data access, corrections, or deletion by contacting us.
